These Terms of Service govern your use of IncluShield and the purchase of services offered through inclushield.com. By accessing this website or purchasing a service, you agree to these Terms of Service.
1. Services
IncluShield provides digital accessibility scanning, reporting, and Shopify-specific remediation guidance for online stores. Services may include, but are not limited to, a Free Intro Scan, a One-Time Scan, and IncluShield Monitoring.
IncluShield services are informational and action-oriented. They are intended to help merchants identify accessibility issues and understand practical next steps for remediation in Shopify.
2. No Legal Advice or Guarantee of Compliance
IncluShield does not provide legal advice. Nothing on this website, in any report, or in any communication from IncluShield should be understood as legal advice or as a legal determination of compliance.
IncluShield does not guarantee WCAG conformance, ADA compliance, or protection from complaints, demands, lawsuits, enforcement actions, or other legal claims.
3. Customer Responsibilities
By placing an order, you agree to provide accurate information, including your email address and the correct public-facing store URL.
IncluShield relies on the information you provide. If you provide an incorrect URL, inaccurate contact information, or a store that cannot be accessed normally, delivery may be delayed or prevented.
Unless otherwise stated, IncluShield scans public-facing pages only and does not require Shopify admin access.
4. Turnaround Times
Any turnaround times shown on the website, including 24–48 hour messaging, are estimates only. Actual delivery times may vary depending on site conditions, order volume, technical limitations, or other factors outside IncluShield’s control.
5. Free Intro Scan
The Free Intro Scan is intended as a limited introductory service. It is designed to provide a brief snapshot of likely accessibility issues and to help merchants decide whether a fuller paid service is appropriate.
IncluShield may limit, delay, or decline free scans in cases of suspected abuse, duplicate submissions, invalid URLs, or technical inaccessibility.
6. Paid Services
Paid services, including the One-Time Scan and IncluShield Monitoring, are digital service products. By purchasing a paid service, you authorize IncluShield to begin review, scanning, analysis, and report preparation in accordance with the service description shown at checkout or on the relevant product page.
7. Subscription Terms
IncluShield Monitoring is a recurring subscription service. By purchasing IncluShield Monitoring, you authorize recurring charges at the stated subscription rate until cancellation.
If you cancel, your subscription will remain active through the end of the current billing period unless otherwise stated at checkout. Cancellation prevents future renewals only and does not entitle you to a refund for services already billed or delivered.
8. Refunds
Because IncluShield sells digital and service-based products, orders are generally non-refundable once work has begun or a report has been delivered.
Refund requests made before work begins may be considered on a case-by-case basis. If IncluShield is unable to deliver the purchased service, or if you were charged in error, please contact support@inclushield.com.
Any approved refund will be issued to the original payment method.
9. Acceptable Use
You agree not to use IncluShield for any unlawful purpose, to interfere with the website or services, or to attempt to misuse free or paid services through repeated abuse, false submissions, automated requests, or similar conduct.
IncluShield reserves the right to refuse or cancel service in cases of suspected fraud, abuse, duplicate orders, invalid store URLs, inaccessible sites, or other circumstances that prevent normal service delivery.
10. Reports and Intellectual Property
All reports, summaries, and remediation guidance provided by IncluShield are for the purchaser’s internal business use in connection with the identified store.
You may not resell, repackage, publicly misrepresent, or present IncluShield materials as legal advice or legal opinions.
All website content, branding, text, graphics, and service materials on inclushield.com remain the property of IncluShield unless otherwise stated.
11. Limitation of Liability
To the fullest extent permitted by law, IncluShield shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, or data arising from or related to the use of the website or services.
IncluShield’s total liability for any claim relating to a paid service shall not exceed the amount actually paid by the customer for that service.
12. No Warranty
IncluShield services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Changes to Services or Terms
IncluShield may update these Terms of Service from time to time. Updated terms will be posted on this page and will apply from the date posted.
IncluShield may also modify, suspend, or discontinue services or website features at any time.
14. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
